Terms and Conditions of sale
These Terms and Conditions apply to all purchases made via www.keltek-brewery.co.uk.
By placing an order, you agree to be bound by these Terms.
1 Definitions
“Buyer” means the person or organisation placing an order.
“Consumer” has the meaning given in section 2(3) of the Consumer Rights Act 2015.
“Contract” means the contract for the sale of Goods formed in accordance with these Terms.
“Goods” means the products offered for sale on the Website.
“Seller” means Keltek Cornish Brewery, Candela House, Cardrew Industrial Estate, Redruth, TR15 1SS.
“Website” means www.keltek-brewery.co.uk
2 Basis of Sale
2.1 These Terms apply to the exclusion of all other terms.
2.2 Nothing in these Terms affects a Consumer’s statutory rights.
2.3 We may update these Terms at any time, but the version in force at the time of order will apply.
3 Orders and Contract Formation
3.1 All orders placed via the Website constitute an offer by the Buyer to purchase Goods.
3.2 An automated order acknowledgement or confirmation email does not constitute acceptance of the order.
3.3 A legally binding Contract is formed only when the Goods are dispatched.
3.4 We reserve the right, at our sole discretion, to refuse or cancel any order at any time prior to dispatch, including (without limitation) where:
- Goods are unavailable
- There are pricing or description errors
- Payment cannot be authorised
- Fraud is suspected
- Age verification fails
- Delivery restrictions apply
- Fulfilment would be unlawful or impractical
3.5 Where an order is cancelled prior to dispatch, our sole liability shall be to refund any sums paid.
4 Price and Payment
4.1 Prices are as displayed on the Website and include VAT where applicable.
4.2 Delivery charges are shown at checkout.
4.3 We take reasonable care to ensure pricing accuracy but reserve the right to cancel orders affected by obvious pricing errors.
4.4 Payment must be received in full before dispatch.
5 Age Restrictions (Alcohol Sales)
5.1 Alcohol may only be purchased by persons aged 18 or over.
5.2 By placing an order, the Buyer confirms they are at least 18 years old.
5.3 We reserve the right to carry out age verification checks.
5.4 Delivery may require proof of age. If suitable identification is not provided, the Goods will not be delivered and the order may be cancelled.
5.5 Where cancellation occurs due to failure of age verification, we reserve the right to deduct reasonable delivery and return costs.
6 Delivery
6.1 Delivery times are estimates only.
6.2 Time for delivery is not of the essence.
6.3 We shall not be liable for delays outside our reasonable control.
6.4 We reserve the right to decline delivery to certain locations due to legal, licensing, courier or logistical restrictions.
6.5 If delivery cannot be completed for such reasons, we may cancel the order and issue a full refund.
6.6 Risk passes on delivery.
6.7 Title passes once full payment has been received.
7 Consumer Cancellation Rights
7.1 Consumers have the right to cancel within 14 days of receiving Goods under the Consumer Contracts Regulations 2013.
7.2 To exercise this right, the Buyer must notify us in writing.
7.3 Goods must be returned within 14 days of cancellation.
7.4 The Buyer is responsible for return costs unless the Goods are faulty.
7.5 Refunds will be processed within 14 days of receiving returned Goods.
7.6 The right to cancel does not apply to:
- Sealed goods unsealed after delivery
- Perishable goods
- Goods made to specification
8 Faulty or Damaged Goods
8.1 Goods are covered by statutory rights under the Consumer Rights Act 2015.
8.2 If Goods are faulty, Consumers may be entitled to repair, replacement, or refund in accordance with statutory rights.
9 Limitation of Liability
9.1 Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence
- Fraud
- Any matter which cannot be excluded under law
9.2 Subject to clause 9.1, our total liability shall not exceed the price paid for the Goods.
9.3 We shall not be liable for indirect, incidental, or consequential loss.
10 Force Majeure
We shall not be liable for failure or delay caused by events beyond our reasonable control, including but not limited to acts of God, war, strikes, transport disruption, supplier failure, or government restrictions.
11 Severance
If any provision is held invalid, the remainder shall remain in force.
12 Governing Law
These Terms are governed by the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
